apartment-architecture-building-2209529On many jobsites across New York City, you will likely see a temporary, skeletal structure inside or outside a building under construction. This is scaffolding and if you do not work in the construction industry, you may not know much about it besides what it looks like.

However, if you work in construction, you almost certainly know what scaffolding is and why it is crucial to your safety. Unfortunately, too many construction sites have improper scaffolding that leads to catastrophic accidents for workers. Oftentimes, scaffolding accidents are linked to failures to ensure it was in compliance with state and federal safety regulations.

For instance, regulations set by the Occupational Safety and Health Administration require various types of scaffolding to:

  • Be able to support its own weight plus four times the intended maximum load
  • Have platforms on working levels that are spaced properly
  • Utilize secured counterweights
  • Not use repaired wire suspension rope
  • Ensure hoists are properly tested
  • Contain wind screens and/or personal fall arrest systems

In New York, there is in place the controversial Scaffold Safety Law, which assigns liability in the event of a scaffolding accident, among other things.

All these laws and regulations are in place to ensure that scaffolding is constructed properly so that it allows workers to safely access heights and navigate areas of a building that have unstable or missing walkways and floors. When scaffolding fails or is not built properly, it can collapse, shift and contain missing parts that make it easy for a worker to fall or get hit by falling objects.

Unfortunately, safety violations involving scaffolding are far too common and it is often the people working on them or the bystanders below them who ultimately pay the price.

If you or a loved one has been injured in a scaffolding accident, talking to an attorney right away can be critical. With legal guidance and support, you can work to uncover any violations or indications of negligence, which will have an impact on liability and the damages you may be eligible to receive.
