I was wounded by an Employee of an Institution that had hired me to renovate a large space to accommodate performances in it’s future. The job included the removal and placement of some very large and heavy Items. Before work began, It was clear that I was in charge, would have my own Crew and that my voice would be the voice that was listened to while moving these Heavy Items. I was told that the Employee (mentioned above)…would be present as an Observer…for “Insurance Purposes.” In Short…I was Not listened to.

An aggressive act by this Employee resulted in the crushed amputation of the end of my right middle finger. The Employer…was a very large Institution of whom I had historically worked for and had supported. Almost immediately… I was being asked to sign releases…which I did Not sign. I was given assurance that my Medical Expenses would be paid for,.. However, the Bills kept arriving. Saddened and Hurt…I continued to get No response from this Institution or their Insurance Representative.

My Brother told me to contact the offices of SMILEY & SMILEY, LLP…and I DID.

It took six years from accident to case resolution. But Smiley and Smiley helped me through that tumultuous time every step of the way.

They were able to were able to get a settlement in my favor, despite a tricky fact pattern and circumstances. The firm NEVER gave up on my case, continuously telling me that I deserve justice and that they were going to fight for me.

$1,000,000 for Fatal Car Accident

$1,000,000 recovered prior to filing a lawsuit for the family of a man killed in a car accident while he was on his way home from work when a van struck his car head-on.

$1,000,000 for the Estate of Two Children Killed in Queens Fire

Smiley Law was retained by the family of two children tragically killed in an apartment fire in Queens. With the help of our forensic fire experts and investigators, we determined the source of the fire, the manner in which it spread, and ultimately what caused the death of two siblings, ages 6 and 10, who resided in the apartment with their mother. It was determined that the owner of the small building had illegally converted the apartment, used the attic as a second-level living space, and failed to provide a proper means of escape in the event of a fire. As a result, when the fire spread, the children were trapped and could not escape. Under New York State’s restrictive Wrongful Death Statute, the family could not legally recover for the emotional distress they suffered from this horrible accident. The family could only be compensated for the children’s conscious pain and suffering prior to their deaths. Smiley Law fought to obtain $1 million for the family. The potential for recovery would be much greater if the law in New York was changed to mirror the laws in most other states, which provide for compensation to a family for emotional distress suffered from the loss of a young child. $1,000,000 for Wrongful Death

$1 Million for the wrongful death of a 42-year-old HIV positive man resulting from a failure by his dentists to timely diagnose oral cancer.

$1,250,000 Million Verdict Awarded to Injured New York Cyclist

$1.25 Million verdict was awarded to a 22-year-old bicyclist who sustained severe injuries to her foot as a result of an illegally parked commercial van.
