activity-blueprint-building-583393Some of the most common and catastrophic injuries on any construction site in the city are those involving falls. This includes falls from heights or being struck by falling objects. In either of these situations, the victim of the accident can suffer serious head, back, brain and neck injuries that could ultimately be fatal or life altering.

There are many regulations and devices on jobsites that can prevent falling accidents or minimize the damage that is suffered in them, but sometimes these measures fail or are improperly utilized. Under these circumstances, it can be critical to investigate the accident and determine if negligence or carelessness contributed to a worker's injuries.

For instance, recently a man was seriously injured when he was working on a Brooklyn jobsite. He was struck on the head by a cinderblock that fell about five feet.

In situations like this one, there are questions that should be answered in order to determine what compensation might be available to the injured party. In this case, it will be important to ask questions like:

  • Was the worker provided with adequate protective gear, like a helmet?
  • Was the man officially on the job when the accident happened?
  • What caused the cinderblock to fall? Was it a careless coworker or faulty machinery?
  • Was the worker properly trained?

Depending on the answers to these and other questions, it can become clear if compensation will be available and if so, what type that might include. In some cases, workers' compensation will be appropriate; in other cases, damages from third-party negligence suit could be available. It is also possible that both types of claims could be filed.

The injuries suffered in falling accidents on a construction site can be tragic, and victims and their families should not be left to pay the price of them alone. With legal guidance, you can assess your legal options to collect compensation if you have been hurt or lost a loved one in these types of accidents.
